Case summary

This case addresses violations of the Clean Air Act (CAA) by Sea Tech and Fun USA, LLC doing business as Aquatech Marine, boat and motor retailer out of Palm Bay, Florida. On July 12th, 2010, Sea Tech imported from China 30 uncertified outboard engines and 22 unlabeled outboard engines. The Marine Spark Ignition Engine regulations under 40 Code of Federal Regulations sections 91.1103 and 1068.101 prohibit any person from importing into the United States a new propulsion marine spark-ignition engine (marine SI engine) unless the engine is covered by an EPA-issued certificate of conformity (COC). These regulations also prohibit any person fiom importing into the United States a marine SI engine unless an appropriate label or tag is afixed to the engine. Of the 52 engines that Sea Tech imported on July 12, 2010, 30 were not covered by a COC and 22 were not labeled. As part of its agreement with EPA, Sea Tech paid a penalty to the US Treasury of $3,800 and exported the 30 uncertified engines. Sea Tech also agreed to either label the other 22 engines, export them outside of the United States or destroy them.
