EPA v. La Terraza Sport

Case summary

This case addresses violations of the Clean Air Act (CAA) by Daniel Quintero Alicea d/b/a La Terraza Sport (La Terraza), based in Canovanas, Puerto Rico. La Terraza imported 10 off highway mini-motorcycles on October 27, 2010. These motorcycles were not covered by an EPA issued Certificate of Conformity. The CAA requires, among other things, that nonroad equipment be covered by an EPA issued Certificate of Conformity (see 40 C.F.R. section 1051). EPA requested that U.S. Customs and Border Patrol (CBP) seize the motors and that CBP bring an enforcement action against La Terraza.
