Case summary

Consignee/importer Juan A. Sepulveda and customs broker Adalberto Rodriguez imported 16 generator sets with an estimated retail value of $80,250 and a declared value of $32,100 into the U.S. The generators were imported in violation of 40 C.F.R. Parts 89 and 90; the generator sets were not covered by a Certificate of Conformity, nor were they labeled in compliance with the regulations. To resolve the violations, Rodriguez and Sepulveda exported the generator sets to a country other than Canada or Mexico, and paid U.S. Customs and Border Patrol $4,155.64 in seizure and storage charges.
