Alleged violations include effluent limit violations for 5-day biological oxygen demand (BOD5) and total suspended solids (TSS), failure to report discharge monitoring reports, failure to have an industrial user survey, failure to develop a quality assurance plan, failure to have an overflow emergency response and public information plan, failure to report occurrences of noncompliance, failure to take representative samples, failure to properly operate and maintain the composite sampler, failure to have pH calibration records, and failure to maintain a copy of the NPDES permit. This Order requires the Respondent to develop and implement an industrial user survey, a quality assurance plan, and an overflow and emergency response and public information plan within 180 days and to install a composite sampler within 180 days. The Respondent is required to submit quarterly reports for a duration of two years. The estimated cost of injunctive relief in $12,500.
