Case summary
On October 23, 2025, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Shoreside Petroleum, Inc. (Respondent) for its main Seward bulk oil storage and distribution facility and associated Seward Marine Industrial Center (SMIC) oil storage tank farm on Resurrection Bay in Seward, Alaska. Respondent failed to adequately implement Clean Water Act Section 311 spill prevention, control and countermeasure (SPCC) and facility response plan (FRP) requirements, including by having inadequate secondary containment at its main facility south tank farm and at its SMIC tank farm. The Respondent undertook and completed secondary containment upgrades to add concrete wall height to both tank farms and updated the facility?s SPCC Plan to remedy the alleged plans? violations, which will provide additional public safety and habitat protection in Resurrection Bay if there is a worst case discharge from the facility. The Respondent has agreed to pay a penalty of $128,000 and has returned to compliance. The estimated cost of injunctive relief is $135,000.
