Case summary
On August 14, 2025, Region 10 issued multiple Administrative Orders on Consent requiring Donna Rowell and Joe Franett to remove a 126-feet long concrete block bulkhead constructed below the high tide line of Swinomish Channel in Mount Vernon, Skagit County, Washington. Respondents also agreed to submit to EPA, for review and approval, a restoration and mitigation work plan to vegetate the shoreline with dune grass and other native species to stabilize the beach substrate and to minimize erosion resulting from boat wakes. Shoreline plantings would commence this fall and become established prior to the complete removal of the bulkhead by next spring.
