Case summary
On February 20, 2025, Region 10 entered into a consent agreement and final order with Clearwater Paper Corporation, for violations of the Clean Air Act (CAA) at its pulp and paper mill facility in Lewiston, Idaho. Region 10 alleges Clearwater Paper Corporation violated the risk management provisions of Section 112(r)(7) of the CAA, 42 U.S.C. 7412(r)(7), and the Risk Management Program regulations at 40 C.F.R. Part 68. The violations include failures to: Conduct an incident investigation following a release of chlorine gas on September 19, 2019; establish and implement complete and adequate written procedures to maintain the on-going integrity of all process equipment in covered processes; have a complete emergency response plan and program; and complete emergency response planning coordination activities in 2019 and 2020. These provisions are aimed at preventing accidental releases of chemicals that can have serious consequences for public health, safety, and the environment. Under the terms of the agreement, the company has agreed to pay a penalty of $440,393. The company has returned to compliance.
