Case summary

On December 18, 2024, EPA Region 10 issued a Notice of Warning to General Chemical in Salem, Oregon, for violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). EPA Region 10 found General Chemical to be in violation of Section 12(a)(1)(E) of FIFRA, 7 U.S.C. 136j(a)(1)(E). This section states that it is unlawful to distribute or sell any pesticide which is misbranded. During a routine inspection, EPA inspectors found General Chemical was not attaching the EPA-accepted version of the label to the immediate containers or the shipping containers for exports of RootX (EPA Reg. No. 68464-1). Such collateral labeling is required under 40 C.F.R. ?168.66 labeling of pesticide products and devices for export.
