Case summary

On November 25, 2024, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Tyree Oil, Inc. (Respondent) for violations of Clean Water Act Section 311 spill prevention, control and countermeasure (SPCC) requirements at its former bulk oil storage and distribution facility in downtown Portland, Oregon, less than one-half mile from the Willamette River. Respondent failed to adequately implement SPCC requirements including the failure to implement adequately sized secondary containment at the facility's truck loading/unloading racks and in a lube oil tank farm. The facility property owner did not renew Tyree's lease so facility operations ceased in late 2023. This action ensures the Respondent is aware of necessary SPCC implementation measures needed to be taken at its other Respondent's SPCC-regulated facilities as means to protect regional surface waters like the Willamette River from oil spills. The Respondent has agreed to pay a penalty of $87,700.
