On December 6, 2023 EPA Region 10 issued a Notice of Warning to Black Rock Trees in Craigmont, Idaho, located on the Nez Perce Reservation, for violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). EPA Region 10 found Black Rock Trees to be in violation of 12(a)(2)(G) of FIFRA, 7 U.S.C. ? 136j(a)(2)(G), which states that it is unlawful to use any registered pesticide in a manner inconsistent with its labeling. Black Rock Trees violated elements of the Worker Protection Standard (WPS) and used the pesticide Talstar P (EPA Reg. No. 279-3206) in a manner inconsistent with its labeling.
