EPA v. Boyer Towing Inc.

Final Order With Penalty

Case summary

On June 7, 2023, Region 10 filed an expedited settlement agreement resolving violations of the Clean Water Act by Bower Towing Inc. in Ketchikan, Alaska. Boyer Towing, Inc. is a bulk fuel storage and marine dock facility located along Tongass Narrows in Ketchikan, Alaska. An EPA spill prevention, control and countermeasure (SPCC) inspection on July 16, 2019 determined Boyer Towing Inc. lacked an SPCC plan and its aboveground storage tanks were not subject to periodic integrity testing. The tank farm's fuel tanks have storage capacity of approximately 150,000 gallons and are located less than one-eighth of a mile from anadromous Hoadley Creek. Boyer Towing agreed to develop an adequate SPCC plan, implement integrity testing protocols for the facility's tank farm, and pay a penalty of $2,844 for the SPCC regulatory violations.
