Case summary

On January 6, 2023, Region 10 filed a consent agreement and final order resolving Clean Water Act Spill Prevention, Control and Countermeasure (SPCC) violations related to the Intalco Aluminum LLC's (Respondent) operation of its aluminum smelter works in Ferndale, Washington. The Intalco works is located within 200 feet of the Georgia Strait, Puget Sound. Respondent undertook corrective actions related to a March 2018 SPCC inspection, including permanent closure of three coal tar pitch tanks which had severe corrosion of the tank bottoms. Puget Sound is important habitat for Pacific Northwest fisheries and a major shipping route.
