Case summary

On December 2, 2022, Region 10 issued an Administrative Penalty Order for alleged violations of the Safe Drinking Water Act by Eni US Operating Co. Inc. located in Beaufort Sea, Alaska. Respondents operate an automotive repair shop in which Respondents conduct repair on motor vehicles. Respondents are alleged to have violated conditions of their Safe Drinking Water Act Underground Injection Control (UIC) permit due to injecting during mechanical integrity failure and above an exceedance of the annulus pressure limitations. Pressure limitations are put in place to avoid fracturing between geologic layers. Injected waste is then limited to a specific area. During this time the pump meter was not operational as required in the permit. EPA has proposed the assessment of $113,000. This action is being simultaneously commenced and concluded in a Consent Agreement and Final Order. The respondent agrees to issuance of this Consent Agreement.
