EPA v. In the Matter of MOHAMMAD ALI, individually and in his capacity as Trustee of BENGAL FAMILY TRUST
Final Order No Penalty
Case summary
On October 20, 2022, EPA Region 10 issued an Administrative Order on Consent (AOC) requiring Mohammad Ali to restore impacted wetlands and tributaries on property owned by the Bengal Family Trust in Soldotna, Alaska. Mr. Ali, individually and in his capacity as Trustee of Bengal Family Trust, oversaw impacts to approximately 5 acres of wetlands and multiple tributaries to the Kenai River as he prepared the property for a potential future cabin development. In addition to being required to restore the wetlands and tributaries to prioritize fish, the AOC requires Bengal Family Trust to execute an environmental covenant that will protect the impacted wetlands and tributaries in perpetuity from future development. A CA/FO seeking civil penalties will be executed at a later date.
