Case summary
On August 4, 2022, EPA Region 10 issued an Administrative Compliance Order to Respondent Russell Vessey to address Clean Water Act (?CWA?) violations at Respondent?s property in Stites, Idaho. Respondent discharged dredged and/or fill material below the ordinary high-water mark of the South Fork of the Clearwater River without authorization under CWA Section 404. This violation resulted in the discharge of pollutants into waters of the United States (?WOTUS?), including potentially contaminated non-native materials. Subject to this Order, Respondent will be required to assess if the fill material is contaminated, remove the material, properly dispose of any contaminated material, and stabilize the affected area. The required activities will stabilize approximately 600 linear feet of bank on the South Fork of the Clearwater River, which is designated critical habitat for ESA fish species.
