Case summary
On August 1, 2022, EPA Region 10 issued an Administrative Compliance Order to Respondents Michael and Janet Reese (Owners) to address Clean Water Act (CWA) violations at Respondents property in North Fork, Idaho. Respondents discharged dredged and/or fill material below the ordinary high-water mark of an unnamed tributary of the North Fork of the Salmon River without authorization under CWA Section 404. These violations resulted in the discharge of pollutants into waters of the United States (WOTUS). The unnamed tributary is critical habitat for ESA fish species. Respondents have agreed to remove the unauthorized fill material, restore the structure and function of the unnamed tributary to support a natural channel design, and provide additional compensatory mitigation for temporal losses.
