1. This Administrative Settlement Agreement and Order on Consent (Settlement) is entered into voluntarily by the United States Environmental Protection Agency (EPA) and the United States Coast Guard (USCG), a branch of the armed forces at all times and a military service in the Department of Homeland Security, except when operating as a service in the Navy upon declaration by the President in time of war pursuant to 14 U.S.C. ? 101. 2. The Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended (CERCLA), 42 U.S.C. ?? 9601-9675, and subsequent delegations of authority have provided USCG with the authority to respond to hazardous substance releases occurring on or from USCG shore facilities. CERCLA and subsequent delegations of authority have provided EPA with authority over releases of hazardous substances, pollutants, and contaminants at National Priority List (NPL) sites, including but not limited to those releases that occur on nonfederal property but also have associated impacts on federal agency installations. 3. Slip 36 of the East Waterway Operable Unit (EWOU) is a part of the Harbor Island Superfund Site (Site) located in Seattle, Washington. Slip 36 is also the open-water area between Pier 36 and Pier 37 of USCG Base Seattle.
