Case summary

On June 29, 2022, EPA Region 10 issued an expedited settlement agreement resolving CWA violations by Avimor Development, LLC for its Avimor Village I construction site in Boise, Idaho. EPA alleged that Avimor Development, LLC failed to take the following actions required by EPA?s Stormwater Construction General Permit (CGP): 1) update the Storm Water Pollution Prevention Plan, 2) conduct and document self-inspections at the required frequency and 3) install and maintain Best Management Practices. Correcting identified deficiencies resulted in an estimated 2,813,197 fewer pounds of sediment delivered to Spring Valley Creek, a receiving water having a Tier 2 designation. This area drains to the Lower Boise River watershed which is listed as water quality impaired and has a TMDL for sedimentation/siltation as well as other pollutants. Respondents have agreed to pay a penalty of $5,280 and will spend an estimated $4,000 to return to compliance.
