Case summary

On April 29, 2022, Region 10 issued an expedited settlement agreement resolving CWA violation by Toll Bros., Inc., for its Bicentennial Farm construction site in Meridian, Idaho. EPA Region 10 alleged that Toll Bros., Inc., failed to take the following actions required by EPA?s Stormwater Construction General Permit (CGP): update information on the public notice board and in the Stormwater Water Pollution Prevention Plan (SWPPP), conduct/document self-inspections at the required frequency for sites discharging to a nutrient-impaired water body, and install and maintain silt fence(s) . Correcting these CGP requirements is estimated to have reduced the delivery of 66,954 pounds of sediment associated with construction activities from reaching Ten Mile Creek. This area drains to the Lower Boise River watershed which is listed as water quality impaired and has a TMDL for sedimentation/siltation as well as other pollutant. Respondent has agreed to pay a penalty of $2,400 and will spend as estimated $750 to return to compliance.
