On April 29, 2022, EPA Region 10 issued an expedited settlement agreement resolving CWA violations by Mountain Scape, Inc. & Tricore Investments, LLC for the Cove at Whiskey Jack, First Addition construction site near Sand Point, Idaho. EPA Region 10 alleged that at the time of a May 26, 2021 Idaho Department of Environmental Quality (IDEQ) inspection, Mountain Scape, Inc. & Tricore Investments, LLC failed to obtain coverage under EPA?s Construction General Permit, develop a Stormwater Pollution Prevention Plan, and conduct/record self-inspection at the frequency required for potential discharges to nutrient impaired Boyer Slough. IDEQ identified Boyer Slough as impaired by phosphorus, nitrogen and ammonia. Site is adjacent to Boyer Slough. Respondents have agreed to pay a penalty of $13,200 and will spend an estimated $3,000 to return to compliance.
