Region 10 Settles with Granite Excavation Inc. & M3 Companies, LLC for Clean Water Act (CWA) Violations (Kuna, ID) On March 10, 2022, EPA Region 10 issued an expedited settlement agreement resolving CWA violations by Granite Excavation, Inc. & M3 Companies, LLC for their Kuna Road Sewer Extension construction site in Kuna, Idaho. EPA Region 10 alleged that Granite Excavation, Inc. & M3 Companies, LLC EPA failed to take the following actions required by EPA?s Stormwater Construction General Permit (CGP): document and fix best management practices in disrepair, good housekeeping practices and other practices limiting the discharge of pollutants, conduct all required self-inspection reports, and have all required information on the SWPPP?s site map. Correcting these CGP requirements should reduce the delivery of 12,111 pounds of sediment plus other pollutants associated with construction activities from reaching Indian Creek, Indian Creek Reservoir, New York Canal and Mason Creek. This area drains to the Lower Boise River watershed which is listed as water quality impaired and has a TMDL for sedimentation/siltation as well as other pollutants. Respondents have agreed to pay a penalty of $12,375 and will spend an estimated $1,500 to return to compliance.
