Case summary

On August 4, 2022, Region 10 entered into an administrative Consent Agreement and Final Order with Powertech Diesel, LLC (Powertech) for violations of Title II of the Clean Air Act. Between September 6 and October 15, 2019, Premier sold at least 6 parts or component that defeat or remove required emission controls on automobiles, including heavy-duty diesel vehicles. Additionally, Powertech advertised at least 23 defeat devices on the companys website and failed to provide a complete and timely response to EPA?s request for information. The $55,000 penalty was reduced due to Powertechs inability to pay a larger civil penalty. This settlement is part of EPA?s National Compliance Initiative for ?Stopping Aftermarket Parts Defeat Devices for Vehicles and Engines.
