Case summary
This Settlement is intended to establish the roles and responsibilities of the EPA and USCG as USCG performs an Engineering Evaluation/Cost Analysis (EE/CA) to identify and evaluate the removal action alternatives for Slip 36. EPA has issued an EE/CA Approval Memorandum and established an information repository and administrative record file for Slip 36 in accordance with 40 C.F.R. ? 300.415(n)(4)(i) of the National Oil and Hazardous Substances Pollution Contingency Plan (NCP). USCG has jurisdiction to perform a CERCLA removal action at Slip 36 by the authority vested in the President of the United States under Section 104(a) of CERCLA, 42 U.S.C. ? 9604(a), and delegated to heads of federal facilities on January 23,1987, by Executive Order 12580, 52 Fed. Reg. 2923 (Jan. 29, 1987).
