Case summary
On August 30, 2021, EPA Region 10 and the Nez Perce Tribe entered into an Administrative Order on Consent (AOC) to address violations of the Safe Drinking Water Act (SDWA) at the Tribe's Clearwater River Casino and Lodge, located on the Nez Perce Reservation in the State of Idaho. EPA found the Tribe, which operates a system that provides water for human consumption, had numerous violations of the SDWA. The violations include failure to correct significant deficiencies within 120-days of notification of the deficiencies by EPA, failure to conduct required sampling for inorganic contaminants, failed to sample for polychlorinated biphenyls (PCBs) between January 2017 and December 2019, and failed to provide public notice of lead monitoring within 30 days after learning the of the lead tap monitoring results for samples collected between June 1, 2020 and September 20, 2020. With this AOC, the Tribe agrees to take specific actions to address the violations. Those actions include excavating and cleaning the area around the flapper of the water storage tank; developing an operation and maintenance plan for the system that includes, at a minimum, an operations plan for the system, maintenance information relating to the system, including maintenance checklists and schedules, and manufacturer?s information; delivering a lead (Pb) consumer notice of individual tap monitoring results to all persons served by the system, and conduct monthly coliform monitoring. Taking these actions will enhance public health protections for approximately 650 people served by this drinking water system.
