Case summary

Expedited Settlement Agreement (ESA). EPA Region 10 Settles with AD800, LLC & Brownstone Construction Management (Eagle, ID) for CWA Violations. On September 27, 2021, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by AD800, LLC & Brownstone Construction Management for their Avebury Subdivision construction site in Meridian, Idaho. AD800, LLC & Brownstone Construction Management failed to obtain coverage under EPA's NPDES Construction General Permit (CGP), provide timely stabilization, and provide reports showing self-inspections. This River system is listed as impaired for sedimentation/siltation, temperature, Chlorpyrifos and Malathion. The Respondents have agreed to pay a penalty of $8,160 and return to compliance. The estimated cost of injunctive relief is $1,500.
