Case summary
On July 16, 2021, Region 10 filed an expedited settlement agreement which both initiated and concluded an administrative action against Forrest Paint Company (Forrest Paint) in Eugene, Oregon for violations of CAA 112(r) Risk Management Program requirements. Respondent failed to comply with several risk management program requirements that apply to its use of butan and propane. Most importantly, Forrest Paint failed to properly document the resolution and action taken to address findings and recommendation in their process hazard analysis (PHA) including updating their PHA to identify any new hazards in preventing a fire or explosion that could impact the community surrounding its facility. In addition, Forrest Paint failed to conduct a compliance audit at least every three years to identify and resolve findings to address operator training, operating procedures and equipment maintenance for the safe operation of the facility to prevent a fire or explosion. A plan provides important information to emergency responders and planners that include accurate chemical quantities, emergency contacts and demonstrate operation and maintenance of the ammonia refrigeration process at its facility. The company agreed to pay a penalty of $3,840.
