Case summary

On September 14, 2020, EPA notified Astro Auto Wrecking LLC of Federal Way, King County, Washington (Respondent) of alleged violations of the Clean Water Act (CWA) and Washington states Industrial Stormwater General Permit (ISGP). The Respondent's violations included failure to conduct quarterly sampling; failure to use secondary containment; failure to implement best management practices; failure to maintain a complete Stormwater Pollution Prevention Plan (SWPPP); and failure to submit required reports. When respondent ceased communications with EPA, EPA filed an Administrative Complaint on April 29, 2021. On May 1, 2023, the Regional Judicial Officer signed a Default Order and Initial Decision. The Default Order assessed a penalty of $35,400 to be paid by the Respondent not later than May 31, 2023. The Environmental Benefit of this enforcement action is an annual reduction in the following pollutants entering waters of the U.S.; Nitrate + Nitrite Nitrogen (33 lbs); Total Suspended Solids (8,764 lbs), Total Aluminum (182 lbs); Total Iron (221 lbs); and Total Lead (2 lbs).
