On September 30, 2026, the U.S. District Court for the District of Alaska entered a Consent Decree resolving Clean Water Act violations by Duran Construction Company LLC, Marciano Duran, and Josette Duran (collectively Duran ) at multiple locations in Juneau, Alaska. The United States and the State of Alaska Department of Environmental Conservation ( ADEC ) are co-plaintiffs in the matter. Duran discharged dredged and fill material without authorization pursuant to Clean Water Act Section 404, discharged pollutants without Alaska Pollutant Discharge Elimination System permit coverage from ADEC pursuant to Clean Water Act Section 402, and violated the terms of a Construction General Permit issued by ADEC pursuant to Clean Water Act Section 402. The Consent Decree requires that Duran perform mitigation work at all sites, including actions designed to improve water quality and salmon rearing habitat. The Consent Decree also requires that Duran pay a total civil penalty of $350,000.
