Case summary

On June 8 , 2026, the U.S. Department of Justice, on behalf of EPA Region 10, and the State of Alaska Department of Environmental Conservation jointly lodged a Consent Decree in the U.S. District Court for the District of Alaska resolving Clean Water Act violations by Duran Construction Company LLC, Marciano Duran, and Josette Duran (collectively ?Duran?) at multiple locations in Juneau, Alaska. Duran discharged dredged and fill material without authorization pursuant to Clean Water Act Section 404, 33 U.S.C. ? 1344, and discharged construction stormwater without Alaska Pollutant Discharge Elimination System permit coverage from the State of Alaska Department of Environmental Conservation pursuant to CWA Section 402, 33 U.S.C. ? 1342. The Consent Decree requires that Duran perform mitigation work at all sites. At one site, work will implement actions designed to improve water quality and salmon rearing habitat. Duran is also required to record a conservation easement to protect the restored area from further disturbance. The Consent Decree requires that Duran pay a total civil penalty of $350,000.
