On October 1, 2020, EPA Region 10 settled with Emerald Kalama Chemical, LLC (Kalama, Washington) for violations of Washington State?s RCRA-authorized dangerous waste regulations regarding obtaining a permit to store dangerous waste, air emissions standards for equipment leaks (Subpart BB), and air emissions standards for tanks, surface impoundments, and containers (Subpart CC). Emerald Kalama Chemical, LLC manufactures advanced specialty chemicals for a broad range of consumer and industrial applications, including preservatives, flavors, aroma chemicals, plasticizers, antioxidants, and vulcanization accelerators. During joint compliance inspections conducted in May and October 2019, the EPA and Washington Department of Ecology inspectors identified the following violations: storage of dangerous waste without a permit; storage of volatile organic dangerous waste in a container that does not meet regulatory requirements; failure to mark each piece of equipment subject to WAC 173-303-691 and 40 C.F.R. Part 264, Subpart BB in such a manner that it can be distinguished readily from other pieces of equipment; failure to include each piece of equipment subject to WAC 173- 303-691 and 40 C.F.R. Part 264, Subpart BB in the facility operating record; and failure to immediately replace the carbon in filter F-313 upon carbon breakthrough. Emerald Kalama Chemical, LLC agreed to pay a penalty of $121,478 to resolve the violations.
