Case summary

On July 29, 2020, Region 10 filed an expedited settlement agreement which both initiated and concluded an administrative action against SureCrop Farm Services (SureCrop) in Junction City, Oregon for violations of CAA 112(r) Risk Management Program requirements. Respondent failed to assign the correct program level for their anhydrous ammonia storage and handling process used to produce fertilizer. Most importantly, SureCrop did not (1) document the resolution of their hazard review findings; (2) provide refresher training records required every three years for their operators; and (3) conduct a compliance audit at least every three years to verify that the procedures and practices are adequate and are being followed. Compliance with risk management program requirements helps prevent accidental releases of hazardous substances and minimize the consequences of any releases that do occur. The company agreed to pay a penalty of $9,500.
