EPA v. SCOTT SHELLY
Final Order No Penalty
Case summary
In February 2020, the EPA issued an AOC to Scott Shelley to resolve CWA violations in Portage, Alaska, resulting from the discharge of dredged and fill materials below the ordinary high-water mark of the unnamed dis tributaries of Explorer Creek and an unnamed slough without a CWA Section 404 permit from the Corps of Engineers. Respondent agreed to remove certain unauthorized fill material and implement and EPA approved Restoration and Mitigation Work Plan to improve salmon habitat by creating shallow littoral shoreline habitat along Shelley's Pond.
