EPA v. Caribou Trail Pest Control

Case summary

On December 10, 2019, EPA Region 10 settled with Caribou Trail Pest Control, LLC (Okanogan, Washington) for violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Caribou Trail is owned and operated by a licensed commercial pesticide applicator. On June 6, 2018, Caribou Trail applied the pesticides Tordon 22K and Weedmaster along a roadway in the Colville Reservation. On July 8, 2016, an EPA-credentialed tribal inspector investigated the application for compliance with FIFRA. The inspector collected vegetation samples, took photographs of damaged vegetation, interviewed the applicator and employees of the Confederated Tribes of the Colville Reservation. Subsequent review of the information revealed that Caribou Trail applied both pesticides in a manner inconsistent with the both products? labeling by applying directly to surface water. See FIFRA Section 12(a)(2)(G). Tordon 22K is a restricted use product and is highly toxic to non-target plants and persistent in groundwater. The company agreed to pay a civil penalty of $2,000.
