Respondent failed to comply with four risk management program requirements that apply to its use of anhydrous ammonia. Wilbur-Ellis Company LLC did not (1) provide refresher training to two employees operating the process every three years; (2) have written operating procedures for an emergency shutdown or consequences of deviations; (3) maintain up-to-date safety information related to the maximum intended inventory; and (4) certify compliance audits are conducted at least every three years to verify that the procedures and practices are adequate and are being followed. These four requirements help prevent an accident and spells out emergency response procedures should an accident occur. The company agreed to pay a penalty of $4,500.
