Case summary
On July 10, 2019, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by East Valley Cattle, LLC and Bill Millenkamp, located in Declo, ID. Respondents violated the CWA by filling approximately 425 linear foot meander in the Raft River. Additionally, an approximately 114 linear foot earthen dam in the Raft River diverted flow from the River to the recharge basin, from which the overflow re-entered the River on the downstream end of the basin. Respondents removed the earthen dam from the Raft River in April of 2018 as soon as they were alerted to the need for a permit. This work was done without a Department of the Army Clean Water Act Section 404 permit. Respondents agreed to pay a penalty of $17,500.
