On May 7, 2019 Region 10 settled with Shining Ocean, Inc. for violations of EPCRA 304 and CERCLA 103 for failure to timely report an ammonia release at its facility in Sumner, Washington. Respondent agreed to pay a penalty of $12,285. In addition, Respondent will implement a SEP valued at $130,392 to upgrade and expand the existing ammonia refrigeration control system at the facility. The system upgrade includes an Automatic Leak Control System that will (a) shut the flow/feeds of ammonia to all cooling units in the zone of the leak, (b) adjust suction pressure at the compressors to draw ammonia away from the leak and back into the high-pressure receiver, and (c) provide real-time readings from every ammonia leak detector in the facility, allowing operators and emergency responders to view and monitor airborne levels of ammonia prior to entry.
