EPA v. LINDLEY DAIRY
Final Order No Penalty
Case summary
On July 20, 2018, Region 10 filed an Administrative Order on Consent to resolve violations of the Clean Water Act by Lindley Dairy, located in Meridian, Idaho. Respondent, a dairy operation, discharged pollutants to waters of the United States from an onsite waste lagoon without authorization or a permit issued under the NPDES program. This discharge was part of an attempted land application system, but was not correctly planned or engineered to avoid or prevent unauthorized discharge. Proper application of nutrients at agronomic rates provides crops with correct nutrient concentrations and, by doing so, protects water quality by limiting contaminated runoff.
