Case summary

R10 Issued an Unilateral SDWA Order to BIA regarding PWS on Nez Perce Reservation (Lapwai, ID) On April 3, 2018, Region 10 sent a SDWA unilateral administrative order (UAO) that requires the BIA to return their North Idaho PWS to compliance with unaddressed significant deficiencies which EPA first notified BIA of in 2016. The UAO requires BIA to provide a corrective action plan for EPA's approval within 60 days of the effective date of the UAO and address the significant deficiencies in accordance with that corrective action plan. Because this action is being issued to a federal facility, BIA had an opportunity to confer with EPA before the UAO became final on April 12, 2018. R10 coordinated this action with FFEO. R10 has also coordinated with Nez Perce tribal representatives about the UAO, and sent a solicitation letter on April 3, 2018 to the Nez Perce Indian Tribe chairman before the UAO became final.
