Case summary
On 03/02/2018, EPA Region 10 issued a Stop Sale, Use, or Removal Order (SSURO) to Newco, Inc., doing business as Cascade Columbia Distribution Company (Seattle, Washington) to stop the distribution and sale of the misbranded product Sodium Hypochlorite Solution 12.5% (EPA Reg. No. 10897-26-73015). Cascade Columbia produces the product in two production establishments, one in Sherwood, Oregon and a second in Seattle, Washington. Based on inspections conducted by the Oregon Department of Agriculture and EPA Region 10 of both establishments, EPA has evidence that Cascade Columbia is distributing the product in violation of FIFRA. Specifically, an EPA review of the product label observed and collected during the inspections found that the label for Sodium Hypochlorite Solution 12.5% did not match the EPA Accepted Label for the product. EPA found deficiencies in the sections of the label regarding Hazards to Humans and Domestic Animals, Environmental Hazards, Physical and Chemical Hazards, and Storage and Disposal. Therefore, as labeled, the product is misbranded as that term is defined in Sections 2(q)(1)(F) and (G) of FIFRA, 7 U.S.C. 136(q)(1)(F) and (G). This SSURO is the result of collaboration with Oregon Department of Agriculture and EPA Region 10 Pesticide Toxics Unit.
