Case summary
On March 29, 2018, Region 10 filed a consent agreement and final order against Granite Construction Company, Okanogan, Washington to resolve violations of the Clean Air Act (CAA) that occurred during operation of its Hot Mix Asphalt plant located on the Colville Reservation in Okanogan, Washington. The company had initially applied for a source-specific minor permit to avoid the Title V operating permit program. At Region 10s request, the company applied instead for coverage under the Hot Mix Asphalt General Permit. The facility exceeded its permitted NOx concentration limit during a performance test, although its emissions at no time exceeded the synthetic minor permit limits in the HMA General Permit. Granite has reapplied for a source-specific synthetic minor permit. Region 10 and Granite have entered into an Administrative Compliance Order on Consent, under which Granite has agreed to cooperate with EPA in issuance of a source-specific minor permit. The settlement includes a penalty of $9,347.
