On February 26, 2018, Region 10 filed a consent agreement and final order with Dean and Dorothy Orbison and the Orbison Community Property Trust (Respondents) to resolve Clean Water Act violations in Sitka, Alaska. Respondents violated the CWA by discharging approximately 400 cubic yards of dredged and/or fill material along 108 linear feet of shoreline, below the ordinary high water mark of Swan Lake, which is designated by the City and Borough of Sitka as an Area Meriting Special Attention. Respondents agreed to remove certain unauthorized fill material and implement an EPA approved Restoration and Mitigation Work Plan to reestablish the vegetated shoreline of Swan Lake for fish and wildlife habitat and to pay a penalty of $13,500.00.
