Case summary

On February 14, 2018, EPA Region 10 filed a consent agreement and final order with Amazon Services LLC (Amazon), headquartered in Seattle, Washington, for the unlawful distribution or sale of unregistered and misbranded pesticides on 3,792 separate occasions. The violations involve six foreign manufactured pesticides that were never registered with the EPA as pesticides. The products 3Pcs. Cockroach Cockroaches Bugs Ants Roach Kills Chalk, Miraculous Insecticide Chalk, HUA Highly effective Cockroach killing Bait Powder, R.B.T.Z. Highly effective Cockroach killing Bait Powder, Green Leaf Powder Fly Killing Bait, and ARS Mat 12 were never reviewed by EPA for their environmental and human health risks prior to Amazon facilitating their distribution and sale across the United States. Two of the products, Miraculous Insecticide Chalk and R.B.T.Z. Highly effective Cockroach killing Bait Powder were also found to be misbranded in that their labels and/or labeling claimed that the products were Harmless to Human Being and Animal or CHILD & PET SAFE: Safe to use around children and pets. Distributing or selling unregistered pesticides is a violation of Section 12(a)(1)(A) of FIFRA. Distributing or selling misbranded pesticides is a violation of Section 12(a)(1)(E) of FIFRA, 7 U.S.C. 136j(a)(1)(E). The Respondent has agreed to pay a penalty of $1,215,700 and undertake a Supplemental Environmental Project valued at $1,523,654 to develop an online training course on pesticides regulations and policies applicable to pesticide sellers.
