Case summary

On October 26, 2017 Region 10 issued a Consent and Final Order (CAFO) to Thomas and Judith Murray for violations of the Toxic Substances Control Act (TSCA), the Residential Lead-Based Paint Hazard Reduction Act, and the Lead-based Paint Disclosure Rule, 40 C.F.R. Part 745, Subpart F that EPA. The CAFO settles the Administrative Complaint Region 10 issued to the Murrays that alleged that the Murrays failed to comply with the Lead-based Paint Disclosure Rule requirements in Twenty-four separate leases in Omak, Wenatchee and Okanogan, Washington. All of these communities are identified as areas with environmental justice concerns. The Respondents failed to: Make required disclosures; Provide an EPA-Approved Lead Hazard pamphlet; Provide prospective tenants records or reports pertaining to lead-based paint or lead-based paint hazards; Obtain an Affirmation of Receipt from Lessees; and Retain Records for 3 years. Respondents agreed to pay a penalty of $20,000.
