EPA v. Christensen, Inc.

Final Order With Penalty

Case summary

On April 17, 2017, Region 10 filed a consent agreement and final order settled with Christensen, Inc. to resolve violations of EPCRA 312 for failing to report storage of diesel, gasoline, LPG-propane, and motor oils at six of their distribution facilities in Washington State. EPCRA 312 annual Tier II reporting supports emergency planning efforts at the state and local levels and provides the public and local governments with information concerning potential chemical hazards present in their communities. Christensen, Inc. agreed to pay a penalty of $65,670 and agreed to implement a $304,385 Supplemental Environmental Project (SEP) that includes the installation of electronic, web-based monitoring systems on at least 180 underground storage tanks owned by their customers. The monitoring systems will be implemented throughout Washington State and it is anticipated that the SEP will benefit communities burdened by environmental concerns.
