Case summary

On April 14, 2017, Region 10 filed a consent agreement and final order with Joseph O'Meara, Joseph O'Meara Living Trust, and Killarney West Golf Course, Inc. (Respondents) to resolve Clean Water Act violations in Hillsboro, Oregon. Respondents violated the CWA by discharging dredged and/or fill material into waters of the United States without authorization under Section 404 of the Act. The discharge filled below the ordinary high water mark of a 3,960-foot section of the bed and bank of Dairy Creek and along a 739-foot section of Council Creek. Respondents agreed to implement an EPA approved Fill Removal and Restoration Plan to the affected sections of these waterways which provide valuable habitat to Upper Willamette steelhead trout and other aquatic species. Respondents also agreed to pay a penalty of $8,042.
