Case summary

On January 23, 2017, Region 10 filed a consent agreement and final order to resolve Spill Prevention, Control and Countermeasure (SPCC) violations at the Wilcox & Flegel Longview Terminal in Longview, Washington following a July 9, 2015 inspection. The Longview Terminal is less than one mile from the Columbia River. Deficiencies at the terminal included an inadequate SPCC plan and lack of adequate secondary containment in one of the terminal's tank farms. Respondent upgraded the secondary containment, and revised and is implementing an updated SPCC plan. Respondent agreed to pay a penalty of $44,069 and implement a SEP valued at $125,000 for the installation of remote tank and secondary containment monitoring systems at the terminal and another Respondent-owned bulk storage terminal. Respondent's corrective actions and the SEP are designed to prevent oil spills to secondary containment, and to protect neighboring areas and surface waters.
