Case summary

On December 23, 2016, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act (CWA) and Washington's Industrial Stormwater General Permit by Silvastar Forest Products LLC. Respondent operated a wood remanufacturing facility for 25 months without a Stormwater Pollution Prevention Plan (SWPPP) in violation of Washington's Industrial Stormwater General Permit. Respondent had other permit violations, such as a lack of secondary containment, exceedance of maximum pH holding times, lack of required annual training, incorrect discharge monitoring reports (DMRs), monthly visual inspections were not recorded, and annual reports were not submitted. Region 10 inspected the facility as part of ongoing coordination with the state to ensure compliance and enforce clean water rules at industrial facilities to reduce pollutant levels in the Puget Sound. Industrial pollutants, if not properly controlled and treated, enter stormwater and waterways. Contaminated stormwater from industrial facilities is a significant contributor to water pollution in Puget Sound. The Respondent agreed to pay a penalty of $34,500.
