Case summary
On January 5, 2017, Region 10 filed an expedited settlement agreement and final order (ESA) with Circle K Stores, Inc., to address a violation of the Underground Storage Tank (UST) rules at its facility in Kennewick, Washington. Respondent failed to use spill prevention equipment that will prevent release of regulated substance to the environment. Owners should have spill containment to capture any overfill during delivery of product. Corrective actions taken under this settlement to properly operate and maintain the UST system help prevent up to 16,000 gallons of gasoline (two tanks) from potential release to the environment. Respondent replaced the spill containments and agreed to pay a $3,400 penalty. This is the second UST ESA pilot settlement by Region 10 in FY17 using the ESA pilot authority to target repeat violators, while streamlining settlement for EPA and owners/operators.
