Case summary
On September 26, 2016, Region 10 filed a consent agreement and final order resolving Clean Air Act (CAA) violations by Pace International, LLC that occurred at its facility located on the Yakama Indian Reservation in Wapato, Washington. The facility manufactures post-harvest fruit coatings. Pace International, LLC failed to track, calculate, and record the monthly and 12-month rolling emission inventory for Volatile Organic Compounds (VOCs) as required by its air operating permit, timely conduct energy assessments on its two boilers as required by the National Emission Standards for Hazardous Air Pollutants, and timely submit the Notification of Compliance Status Report for completion of the energy assessments on the two boilers. A Region 10 inspector discovered these violations during a routine inspection. Region 10 conducted a follow-up inspection using a FLIR camera. This inspection, in conjunction with expert engineering analysis, enabled the Region to characterize and quantify emissions from this unique source, determine applicability of Title V, and ultimately settle the case. The company agreed to pay a $77,134 penalty. The company also agreed to perform a supplemental environmental project, valued at $78,427, to replace pneumatic pumps and hoses that transfer large quantities of liquids containing volatile organic compounds. The existing pumps and hoses leak and emit VOCs. The new pumps and hoses will significantly reduce leaks and, consequently, reduce vapor emissions.
