Case summary

On August 11, 2016, Region 10 filed a consent agreement and final order with Essential Oil Research Farm, LLC to resolve Clean Water Act violations in Naples, Idaho. Essential Oil Research Farm violated the CWA Section 404 by discharging an unspecified quantity of dredged and/or fill material into waters of the United States without authorization under the Clean Water Act. The discharge filled a section of the bed and bank of an unnamed stream, approximately ten feet in width, three feet in depth, and fifty feet in length. The discharge created an impoundment of water, affecting an upstream area of approximately 100 feet in width and 250 feet in length. Respondent will work with the Army Corps of Engineers to obtain the appropriate after-the-fact permit, which will require the respondent to complete a mitigation project beneficial to the hydrology and aquatic life of the watershed. Essential Oil Research Farm, LLC agreed to pay a penalty of $16,000.
