Case summary
On February 2, 2015, EPA Region 10 issued this Stop Sale, Use, or Removal Order (SSURO) to Environmental Compliance Resources, LLC to stop the further distribution or sale of ECR Calcium Hypochlorite Granules (EPA Reg. No. 86460-1). EPA issued the Order because the labels on the product containers are misbranded as defined by Section 2(q)(1)(D), (F), (G) and 2(q)(2)(C)(iii) of FIFRA, 7 U.S.C. 136(q)(1)(D), (F), (G) and 2(q)(2)(C)(iii). Specifically, the labels are missing important directions for use and precautionary statements including, appropriate rate information and the statement, Re-entry into treated spa / hot tubs is prohibited above 5 ppm due to risk of bodily harm. The label also contains use directions for a different product and describes using the product in a chlorinator. This wording does not appear on the EPA-accepted label. Lastly, the labels do not indicate the net content or the appropriate EPA establishment number for the facility which last produced the product. Distributing or selling misbranded pesticides is a violation of Section 12(a)(1)(E) of FIFRA, 7 U.S.C. 136j(a)(1)(E).
